1. Acceptance of Terms

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. IN NO EVENT WILL VISTA LIVING OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

8. Governing Law

These Terms and your use of the Site and Services are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles. Any legal action or proceeding relating to your access to or use of the Site or Services shall be instituted in a state or federal court in Denver, Colorado. You and Vista Living agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

9. Changes to the Terms

We reserve the right to revise these Terms at any time without prior notice. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are responsible for regularly reviewing these Terms. If you do not agree to the revised Terms, you must stop using the Site and Services. The date of the last update to these Terms will be displayed at the top of this page.
